Are Section 269SS/269T penalties automatic once a cash loan is identified?
The penalty under Section 271D (for 269SS) or 271E (for 269T) is not automatic — it requires a separate penalty proceeding, and "reasonable cause" under Section 273B is a statutory defence the assessee can raise (for example, an isolated transaction under genuine business exigency has sometimes been accepted as reasonable cause in case law). Document the instance and the surrounding facts here; whether reasonable cause applies is a judgment call for the assessee's counsel/CA to argue if the case is selected for penalty proceedings.
Does Section 40A(3) apply to every cash expense over the threshold?
No — Rule 6DD carves out specific exceptions (payments to banks/government, payments in areas not served by a bank, payment on a bank holiday, certain agricultural produce purchases, and several others). Test each instance against Rule 6DD before concluding disallowance applies; a cash payment above the threshold that falls within a Rule 6DD exception is not disallowed.
