Can an HUF be created by a deed or agreement?
No. An HUF arises by operation of Hindu law — by the status of the family — and not by contract. What practitioners loosely call an "HUF creation deed" is really a declaration deed: it evidences the existence, name and composition of an HUF that already exists in law. Banks and the PAN application process ask for exactly this declaration, which is why the deed is drafted.
Is a gift received by an HUF taxable?
Under Section 56(2)(x), gifts whose aggregate exceeds ₹50,000 in a financial year are taxable in the recipient's hands unless received from a "relative". For an HUF, its members are relatives, so a gift from a member is not income of the HUF. However, where a member gifts assets to the HUF, Section 64(2) clubs the income from that converted property back in the member's hands — which is why corpus gifts are often taken from relatives who are not members, such as the karta's father.
What documents are needed to apply for an HUF PAN?
Form 49A is filed in the name of the HUF, signed by the karta. The standard enclosures are this declaration deed (or an affidavit by the karta stating the name, address and members of the HUF), and the karta's own identity and address proof. Once PAN is allotted, the same declaration supports opening the HUF's bank account.
Can a single person form an HUF?
No. An HUF requires a family — at least two members. A Hindu male and his wife can constitute an HUF on marriage even before children are born, and after the Hindu Succession (Amendment) Act, 2005, daughters are coparceners in their father's HUF in the same manner as sons. A sole surviving individual cannot constitute an HUF by himself.
