Can a 154 rectification be filed online?
Yes. For orders and intimations processed by CPC (such as 143(1) intimations), a rectification request is filed directly on the e-filing portal under Services > Rectification, choosing the appropriate request type (reprocess, tax-credit mismatch correction, or return-data correction). For orders passed by the jurisdictional AO, a written application under section 154 is filed with that officer.
What is the time limit for rectification under section 154?
The mistake can be rectified within four years from the end of the financial year in which the order sought to be amended was passed (section 154(7)). Where the assessee makes the application, the authority is required to dispose of it within six months from the end of the month in which it is received (section 154(8)).
What qualifies as a mistake apparent from record?
A mistake that is obvious and patent on the face of the record — an arithmetical error, credit for tax actually paid not being given, or an adjustment contrary to what the return itself shows. A point that requires elaborate argument or on which two views are possible is not a mistake apparent from record; the remedy for a debatable issue is appeal, not rectification.
What are the most common grounds for a rectification application?
TDS or TCS credit appearing in Form 26AS but not allowed in the intimation, incorrect adjustments made while processing under section 143(1), advance tax or self-assessment tax challans not credited, arithmetical errors, and income taxed twice.
