What is the time limit for filing an appeal to the ITAT?
Sixty days from the date on which the order of the CIT(A) is communicated, per section 253(3). The Tribunal may admit an appeal after this period if satisfied there was sufficient cause for the delay — file a condonation petition supported by an affidavit explaining the delay.
How much is the ITAT appeal fee?
Under section 253(6): ₹500 where the assessed total income is up to ₹1 lakh, ₹1,500 where it is between ₹1 lakh and ₹2 lakh, and 1% of the assessed income subject to a maximum of ₹10,000 where it exceeds ₹2 lakh. Where the appeal does not relate to assessed income (e.g. certain penalty or TDS matters), a residual fee of ₹500 applies, and no fee is payable on a memorandum of cross-objections.
What is a paper book in an ITAT appeal?
A paginated, indexed compilation of the documents the appellant relies on at the hearing — the return, financial statements, submissions before the AO and CIT(A), the orders below, and evidence — filed in the number of copies the ITAT Rules prescribe, ahead of the hearing. Every document must be certified as having been on record before the lower authorities; anything new needs a separate application for admission of additional evidence.
How should grounds of appeal before the ITAT be drafted?
The ITAT Rules require grounds to be concise, set out under distinct heads, numbered consecutively, and free of argument or narrative. One issue per ground, alternatives raised "without prejudice", a consequential-interest ground, and the customary leave to add or amend grounds — with the argument reserved for the hearing and the paper book.
