Who needs to file Form 10B?
Every public charitable or religious trust / institution registered under Section 12A or 12AB of the Income-tax Act 1961 must obtain an audit report in Form 10B from a Chartered Accountant if its total income (before exemption under Sections 11 and 12) exceeds the basic exemption limit. Trusts registered under Section 10(23C) follow a similar requirement, with some institutions using Form 10BB.
What's the difference between Form 10B and Form 10BB?
Post the CBDT's 2023 overhaul (Notification 7/2023, effective AY 2023-24), the choice no longer turns on which specific 10(23C) sub-clause applies — Rule 16CC/17B now set one unified test: Form 10B applies if, during the year, total income (before Sections 11/12 exemption) exceeds ₹5 crore, or the trust/institution received any foreign contribution, or applied any income outside India. When is the due date for filing Form 10B?
Form 10B must be furnished at least two months before the due date for filing the trust's return of income under Section 139(1) — not merely "before" it. For most trusts with a 31 October return due date, that means filing Form 10B by 30 September of the assessment year. Failure to file Form 10B on time can result in loss of exemption under Sections 11 and 12.
What is the 85% income application rule referenced in this form?
Under Section 11(1), a trust must apply at least 85% of its income (derived from property held under trust) towards charitable or religious purposes in India during the previous year, to claim exemption. The remaining 15% can be accumulated without restrictions; amounts beyond 15% can be accumulated only by following Section 11(2) — filing Form 10 at least two months before the Section 139(1) due date, and investing in specified modes under Section 11(5).
Who are the "specified persons" under Section 13(3)?
Specified persons include the author/founder of the trust, persons who have contributed more than ₹50,000, any relative of the above, any concern in which any of the above has a substantial interest, and any trustee/manager of the trust. Section 13 disallows exemption if income/property is applied for the direct or indirect benefit of these persons — hence the detailed disclosures in Part B, Section V of the form.
What are "specified violations" and why does Form 10B ask about them?
Specified violations is a concept introduced alongside the 2023 registration regime (Section 12AB(4)) — a defined list of failures (income misapplied, activities not genuine, non-compliance with another law that has attained finality, false information in the registration application, etc.) that can trigger cancellation of registration. The auditor must now specifically report whether any occurred during the year — this wasn't a distinct reporting item under the old pre-2023 Form 10B.
Do I need to file UDIN with Form 10B?
Yes. The Chartered Accountant signing Form 10B must generate and quote a Unique Document Identification Number (UDIN) from the ICAI portal. The UDIN is required on the audit report itself and is verified by the Income-tax department portal at the time of filing.
