When must a trust file Form 10B instead of Form 10BB?
Under Rules 16CC and 17B of the Income-tax Rules (substituted with effect from 1 April 2023, applicable from AY 2023-24), Form 10B applies if the trust's total income before claiming exemption exceeds ₹5 crore during the previous year, OR it received any foreign contribution during the year, OR it applied any part of its income outside India during the year. If none of these three conditions apply, the simpler Form 10BB applies instead. Test all three every year — a trust can flip between forms year to year as its income or activities change.
Does spending from the corpus count towards the 85% application requirement?
No. Explanation 4 to Sec 11(1), inserted by the Finance Act 2021 with effect from AY 2022-23, excludes application out of corpus funds from the 85% test in the year it is spent. It only counts as application in the later year the corpus is replenished — i.e. reinvested or redeposited into the specified Sec 11(5) modes maintained for that corpus — and only to the extent redeposited. The same treatment applies to application funded by loans or borrowings: it counts as application only in the year the loan is repaid out of that year's income, to the extent repaid.
What happens if the trust falls short of the 85% application requirement?
The shortfall can be accumulated under Sec 11(2) for a specified purpose, for a period not exceeding 5 years, provided Form 10 is filed electronically before the due date for filing the return under Sec 139(1) and the accumulated funds are invested in the Sec 11(5) specified modes. Accumulated amounts not applied for the stated purpose within the period become taxable in the year the period expires (or is misused/misapplied, if earlier).
