Who issues RERA Form 5?
Form 5 — the annual report on the statement of accounts of a registered real estate project — is issued by the Chartered Accountant who is the statutory auditor of the promoter's enterprise, on the CA's letterhead. This is distinct from Form 3, which certifies withdrawal proportions and may be issued by a practising CA engaged for that certification.
What is the 70% rule under RERA that Form 5 covers?
Section 4(2)(l)(D) of the Real Estate (Regulation and Development) Act, 2016 requires the promoter to deposit seventy per cent of the amounts realised from allottees, from time to time, in a separate account in a scheduled bank, to be used only to cover the cost of construction and the land cost of that project. Form 5 requires the auditor to certify that these deposits were made and that withdrawals were in proportion to the certified percentage of completion.
How do Forms 1, 2, 3 and 5 fit together under RERA?
Forms 1 (architect), 2 (engineer) and 3 (chartered accountant) are the certificates the promoter obtains each time money is withdrawn from the designated account — together they certify the proportion of project completion that justifies the withdrawal. Form 5 is the once-a-year report in which the statutory auditor looks back over the financial year and certifies that collections, deposits and withdrawals complied with the Act and matched those certifications.
Is Form 5 the same in every State?
The requirement flows from the central Act, but the form itself is prescribed by each State RERA's rules or regulations (MahaRERA, Punjab RERA, Karnataka RERA and others), so the numbering, layout and filing timeline vary marginally between States while the substance — collections, 70% deposits, proportionate withdrawals and agreement with the books — is broadly uniform. Always file on the exact format notified by the Authority concerned.
Is UDIN mandatory on RERA Form 5?
Yes. Form 5 is a certificate issued by a practising CA, so a UDIN generated from udin.icai.org is mandatory and must be quoted on the certificate; RERA authorities can verify it online.
